Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and myCOO.chat ("myCOO", "we", "us") governing your access to and use of the myCOO platform, including the website at mycoo.chat, all associated web applications, and the AI assistant services delivered via WhatsApp and Telegram (collectively, the "Service").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Description of Service
myCOO provides an AI-powered Chief Operating Officer (COO) assistant accessible via WhatsApp, Telegram, and a web dashboard. The Service enables South African entrepreneurs and small business owners to automate administrative tasks, generate business documents (invoices, quotations), manage reminders, and receive business guidance — all from their preferred messaging platform.
The Service is powered by large language model (LLM) technology. AI-generated content is provided for assistance only and does not constitute professional legal, financial, accounting, or tax advice. Always consult a qualified professional for such matters.
2. Eligibility
To use myCOO you must:
- ▸Be at least 18 years of age
- ▸Have the legal capacity to enter into a binding agreement
- ▸Provide accurate and truthful registration information
- ▸Not be prohibited from using the Service under applicable law
3. Account Registration & Security
You must register an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@mycoo.chat if you suspect unauthorised access to your account.
You agree not to create accounts using false identities or on behalf of someone else without authorisation.
4. Subscriptions & Billing
Free Trial
New accounts receive a 14-day free trial with full access to the Service. No credit card is required during the trial period. At the end of the trial, a paid subscription is required to continue using the Service.
Subscription Plans
Paid plans are billed monthly in South African Rand (ZAR) via Paystack. Current pricing is displayed at mycoo.chat/pricing and may be updated with 30 days' notice.
Auto-Renewal
Subscriptions automatically renew at the end of each billing period. You authorise us to charge your payment method on file for the renewal amount.
Cancellation
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time, except where required by applicable law.
Taxes & Fees
Prices displayed include VAT where applicable under South African VAT legislation. You are responsible for any additional taxes applicable in your jurisdiction.
5. Acceptable Use Policy
You agree not to use myCOO to:
- ✕Violate any South African law or regulation
- ✕Infringe the intellectual property rights of any third party
- ✕Transmit spam, unsolicited commercial communications, or malware
- ✕Harass, defame, or threaten any person
- ✕Attempt to reverse engineer, decompile, or extract the source code of the Service
- ✕Circumvent any technical protection measures
- ✕Use the Service to train competing AI models or services
- ✕Access the Service via automated means (bots, scrapers) except as explicitly permitted
- ✕Submit false, misleading, or fraudulent business information to the AI assistant
We reserve the right to suspend or terminate accounts that violate this policy without notice.
6. AI Assistant — Limitations & Accuracy
The AI assistant uses large language model technology and may occasionally produce inaccurate, incomplete, or outdated information. You acknowledge and agree that:
- ▸AI-generated content does not constitute professional advice of any kind
- ▸You must independently verify any important information before acting on it
- ▸Documents generated (invoices, quotations) are templates — you are responsible for their accuracy and legal validity
- ▸myCOO is not liable for any decisions made based on AI output
7. Intellectual Property
myCOO IP: The Service, including all software, design, branding, and AI models, is owned by myCOO.chat or its licensors and is protected by South African and international intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your own business purposes.
Your Content: You retain ownership of all business information, documents, and data you input into the Service ("User Content"). By submitting User Content, you grant us a limited licence to process it solely to provide the Service. We do not use your User Content to train AI models.
Generated Output: Documents and content generated by the AI assistant using your inputs are owned by you, subject to applicable law.
8. Privacy & Data Protection
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, process, and protect your personal information in compliance with the Protection of Personal Information Act, 2013 (POPIA).
9. Service Availability
We strive to provide a reliable service but do not guarantee uninterrupted or error-free availability. The Service may be temporarily unavailable due to maintenance, upgrades, or circumstances beyond our control (including third-party platform outages such as WhatsApp or Telegram). We will endeavour to give advance notice of planned downtime.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, WE DISCLAIM ALL WARRANTIES.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, myCOO.CHAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total cumulative liability to you for any claim arising under these Terms shall not exceed the total amount you paid to us in the 3 months preceding the claim. Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud.
Nothing in this clause affects your rights as a consumer under the Consumer Protection Act, 2008 (CPA), which cannot be contractually excluded.
12. Termination
Either party may terminate these Terms at any time. You may close your account from your dashboard settings. We may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent activity, or if required by law. Upon termination, your licence to use the Service ends. We will retain and delete your data as described in our Privacy Policy.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you via email and/or a prominent notice in the Service at least 14 days before the changes take effect. Your continued use after the effective date constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
14. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. You and myCOO consent to the exclusive jurisdiction of the courts of South Africa for any disputes arising under these Terms.
We encourage you to contact us first at support@mycoo.chat to resolve any dispute amicably before commencing legal proceedings. For consumer disputes, you may also refer the matter to the Consumer Goods and Services Ombud (CGSO) or the National Consumer Commission (NCC).
15. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and myCOO regarding the Service.
Severability: If any provision is held unenforceable, the remaining provisions continue in full force.
Waiver: Failure to enforce any right does not constitute a waiver of that right.
Assignment: You may not assign your rights under these Terms. We may assign ours in connection with a merger or acquisition.
Language: These Terms are written in English. In the event of a conflict between an English version and a translated version, the English version prevails.
